Withdrawal from the Contract
If you are a so-called privileged buyer, meaning:
A) a consumer
or
B) a natural person for whom the contract you have concluded with us is directly related to your business activity, but does not have a professional character for you
– you are, as a rule, entitled to withdraw from a contract concluded at a distance.
You may withdraw from the contract by submitting to us a statement of withdrawal from the contract, e.g. by email sent to: info@dzieciecawyspa.pl.
You may withdraw from the contract within 14 days.
The fourteen-day period for withdrawal from the contract begins when you or a third party indicated by you, other than the carrier, takes possession of the goods, and in the case of a contract covering multiple goods delivered separately, in batches or in parts – from taking possession of the last good, batch or part.
To meet the deadline, it is enough to send the statement before it expires.
Please return the returned goods to us promptly at the address: ul. Józefa Mireckiego 11/29, 42-207 Częstochowa, Poland, no later than within 14 days from the day on which you withdrew from the contract.
We will refund the payments you made promptly, on the terms specified in the Store Regulations, no later than within 14 days from the day we receive your statement of withdrawal from the contract.
If we have not offered to collect the goods from you ourselves, we may withhold reimbursement of the payment received from you until we receive the goods back or you provide proof of sending them back – whichever occurs first.
Please note that the right to withdraw from a contract concluded at a distance does not apply, among others, to a contract:
- where the subject of the service is goods that are not prefabricated, manufactured to your specification or used to meet your individualized needs;
- where the subject of the service is goods that deteriorate quickly or have a short shelf life;
- where the subject of the service is goods delivered in a sealed package which cannot be returned after opening for health or hygiene reasons, if the package was opened after delivery;
- where the subject of the service is audio or video recordings or computer programs delivered in a sealed package, if the package was opened after delivery.

Complaints
The following content applies to the so-called privileged buyer. If you are not one, please refer to our Store Regulations for detailed information on complaints.
If we improperly perform the contract concluded with you, you have the right to file a complaint – preferably to the email address: info@dzieciecawyspa.pl or by post to: ul. Józefa Mireckiego 11/29, 42-207 Częstochowa, Poland.
As a rule, we are liable for the lack of conformity of the goods with the contract that existed at the time of delivery and was discovered within two years from that time.
Under the provisions of the Consumer Rights Act, in such a situation you may demand:
a) replacement of the goods
or
b) repair of the goods.
In some cases you may also:
a) withdraw from the contract
or
b) submit a statement of price reduction
